Terms of use

These terms govern your use of whmiscert.ca (the "Site"), the WHMIS course, exam and certificate of completion, and the annual refresher (the "Services"), provided by AFFINITI ("we", "us"). By using the Site you agree to them.

1. What the Services are

The course delivers the generic Education Component of Canada's Workplace Hazardous Materials Information System (WHMIS 2015, including the Hazardous Products Regulations amendments in force December 15, 2022, with the supplier transition period ending December 15, 2025). The exam tests that material. The certificate of completion records that the named person completed the course and passed the exam on the stated date with the stated score.

Important notice. We are an independent training provider. No federal, provincial or territorial regulator approves training providers or issues WHMIS certificates to workers; a certificate of completion is a record, not a licence. Employers remain responsible under their jurisdiction's occupational health and safety law for workplace-specific training, for ensuring workers can apply it, for reviewing their WHMIS program at least annually, and for keeping training records. Whether to accept any training record is the employer's decision. The Services are not legal advice and do not guarantee employment, access, or compliance.

2. Eligibility and accuracy

You must be at least 16 years old to purchase a certificate. You agree to enter your own legal name and a working email address, to complete the exam yourself without assistance, and not to obtain a certificate for anyone else. Certificates obtained by misrepresentation are void and may be removed from the verification record.

3. Prices and payment

The course, exam and certificate together cost CAD 24.95, and the annual refresher CAD 9.95, one-time, in Canadian dollars, plus any tax shown at checkout. Payment is processed by Stripe; we don't store card details. Prices may change; the price shown at checkout applies.

4. Delivery and refunds

Course access is granted immediately after payment, and the certificate is a digital product issued immediately when you pass the exam, by download and by email. You may request a full refund within 7 days of purchase provided you have not attempted the final exam. Otherwise sales are final, except: duplicate charges; failure to deliver that we cannot resolve within 5 business days; or where applicable consumer-protection law requires a refund. One free reissue for a spelling correction is available within 7 days of issue. See the refund policy below.

5. Verification record

Each certificate has an ID and QR code. The verification page shows the holder's name, completion date, jurisdiction and recommended review date to anyone who enters the ID; by purchasing you consent to this disclosure, which is the purpose of the certificate. Scores and contact details are not shown. We may remove a record for fraud or misrepresentation.

6. Review date and refresher

The recommended review date is 12 months after completion, reflecting the annual review employers must carry out. It is a recommendation; no law sets an expiry date for worker education. Refresher reminders are sent only with your consent and can be stopped at any time.

7. Intellectual property

Course content, questions, design and code are owned by AFFINITI. You may use them for your own learning and share your certificate with employers. You may not copy, republish or resell the course or exam. GHS pictograms are UN material and are not claimed.

8. Acceptable use

No automated access, no attempts to extract exam answers, no interference with the Site or the verification record, no use of the Services for unlawful purposes.

9. Disclaimer and limitation of liability

The Services are provided "as is". We keep the content current with the regulations to the best of our ability but do not warrant that it is complete, error-free, or sufficient for any particular workplace, and we are not responsible for your employer's acceptance decisions or for any injury, loss or claim arising from workplace hazards. To the maximum extent permitted by law, our total liability for any claim relating to the Services is limited to the amount you paid us in the 12 months before the claim.

10. Privacy

Our privacy policy below explains what we collect and why.

11. Changes

We may update these terms; the date above shows the current version. Continued use after a change means you accept it.

12. Governing law

These terms are governed by the laws of Ontario and the federal laws of Canada applicable there. Disputes will be brought in the courts of Ontario, without limiting any rights you have under the consumer-protection law of your own province.

Refund policy

Module 1 is open to everyone, so you can judge the course before paying. The course opens the moment payment completes, and the certificate is issued the moment you pass the exam. Refunds:

  • Change of mind. Full refund within 7 days of purchase if you have not attempted the final exam. Email us from the address you used to buy; course access is cancelled when the refund is made.

After an exam attempt, or after 7 days, all sales are final, with these exceptions:

  • Duplicate charge. If you were charged twice for one certificate, we refund the duplicate.
  • Delivery failure. If you paid and did not receive a working certificate link, and we cannot fix it within 5 business days of you telling us, we refund in full.
  • Where the law requires. Consumer-protection law in your province may give you rights that override this policy; nothing here limits them.

Name corrections are not refunds: email us the certificate ID and the correct spelling within 7 days and we reissue once at no charge.

Refunds are made to the original payment method through Stripe and typically appear within 5–10 business days. To request one, email contact@whmiscert.ca with your certificate ID or Stripe receipt.

Privacy policy

What we collect

  • Reading the course: nothing personal. Module progress is stored in your own browser (local storage), not on our servers.
  • Enrolling for the exam: your name, email, jurisdiction, whether you consented to review reminders, the landing page or ad click that brought you (if any), and your IP address.
  • Taking the exam: your answers, score, number of attempts and date.
  • Buying a certificate: Stripe collects your payment details; we receive a payment reference, the amount and your billing email. We never see your card number.
  • Analytics: Google Analytics and Google Ads conversion tracking (cookies), used to measure which pages and ads lead to course starts and purchases. After a purchase we send Google a hashed version of your email for ad measurement ("enhanced conversions"). You can block these with a cookie blocker or Google's opt-out.

Why

To issue your certificate with the right name, to email it to you, to let employers verify it, to send review reminders you asked for, to prevent fraud, to handle support and refunds, and to measure and improve the Site and our advertising.

The verification page

Anyone who enters your certificate ID sees your name, completion date, jurisdiction and recommended review date. That is the purpose of the certificate. Your score, email and other details are never shown.

Who else sees it

Stripe (payment), Resend (email delivery), Upstash (database), Vercel (hosting), Google (analytics and ads). Each processes data on our instructions under its own privacy terms. Servers may be located in the United States. We don't sell or rent personal information.

How long we keep it

Certificate records are kept as long as the verification service exists, so employers can confirm them. Exam attempts and enrolment data are kept for 3 years. Payment records are kept for 7 years as required for tax purposes.

Your choices

  • Review reminders are opt-in; reply to any reminder or email us to stop them.
  • You can ask for a copy of your data, a correction, or deletion. Deletion removes the certificate from the verification record, so we'll confirm before doing it.
  • Questions or complaints: contact@whmiscert.ca. You may also contact the Office of the Privacy Commissioner of Canada.

Security

Data is transmitted over HTTPS, access links are signed, and exam answers are graded on the server. No system is perfectly secure; if we learn of a breach affecting you we will tell you.

Children

The Services are for people of working age. We don't knowingly collect information from anyone under 16.

Changes

We'll update the date above when this policy changes.
